What Is the Difference Between an Attorney and a Lawyer?

Attorney Springfield, MO

When you need legal counsel, an attorney is the right person to turn to for help. This professional can give you legal advice and represent you whether you are a defendant or a plaintiff. Attorneys will work hard to protect your rights and interests. The chances of having a positive outcome are higher when you have an experienced attorney taking your case. The terms attorney and lawyer are often used interchangeably. However, there are important differences that you should be aware of when you seek to hire a legal professional.

Why choose an attorney

If a person is accused of a crime, that individual has the right to legal counsel. The person can also choose to represent themselves in a legal matter. However, an attorney has legal knowledge and experience that the common person does not have. The right attorney has a track record of representing clients in a variety of legal issues. A good attorney understands the legal process, including how to conduct a case in court, what filings are necessary, and how to negotiate with the other party. Finally, a legal professional can identify when there may have been a violation of a person’s constitutional rights.

Education and exams

One of the most notable differences between an attorney and a lawyer lies in the education both receive and what happens after their schooling. To become either an attorney or a lawyer, the individual must graduate from law school. This comprises three years of study. To become a practicing attorney, a person must then pass the bar exam. To practice in a given state, the individual must pass that state’s specific exam.

However, this is not the case with a lawyer. Though a lawyer must complete law school, the person does not have to pass the bar exam. In fact, a lawyer does not even have to take the exam. A lawyer can practice in a certain area having never attempted to take a bar exam in any state.

Differences in practice

An attorney is a legal professional who practices in court. Attorneys represent clients who have gone to court either for criminal or civil issues. Attorneys must follow certain courtroom etiquette and a code of ethics. Conversely, lawyers do not always practice in the courtroom. Instead, a lawyer will provide legal advice and may act as an adviser in a case.

Attorneys are more all-encompassing

Many people assume that an attorney and a lawyer are the same. This is only partially true. For example, all attorneys are lawyers. However, not all lawyers are attorneys. A person could graduate from law school but never be a licensed attorney, able to represent a client in the courtroom.

Know which legal professional you need

As you understand the differences between an attorney and a lawyer, you will be able to make the right choice for your needs. If you are going to court and need a licensed legal counselor to be your advocate, choose an attorney. If you need legal advice or guidance for a matter outside of the courtroom, a lawyer may be a good option. Get the right legal help today.
